Off duty ICE agent shot after attacking Fresno family on their lawn, police say

An off duty federal immigration agent was shot early Friday in Fresno, California after police say he drunkenly attacked a 72 year old homeowner who asked him to leave the family's front lawn, where he had passed out. David Gonzalez, 32, of Texas was taken into custody on suspicion of assault charges; the homeowner, who used a legally owned firearm, faces no charges.

An off duty Immigration and Customs Enforcement agent is in custody in Fresno, California after police say he passed out drunk on a family's front lawn, then attacked the homeowner and his daughter when they tried to wake him.

Fresno police identified the agent as David Gonzalez, 32, of Texas. Officers responding to a 3:20 a.m. call Friday found Gonzalez in handcuffs with a gunshot wound to the stomach near North Broadway Street and East Dudley Avenue. The daughter's boyfriend, an off duty police officer, had detained him until officers arrived.

According to police, a woman returned home early Friday and found Gonzalez asleep on the family's front lawn. She called her 72 year old father, who came outside to wake the stranger and tell him to leave. Gonzalez appeared intoxicated and agitated, police said, then struck the older man and forced him to the ground. When the daughter tried to intervene, Gonzalez turned on her and attacked her as well.

Fearing for their safety, the 72 year old grabbed his firearm and fired a single shot, striking Gonzalez. Police determined the gun was legally owned and said the homeowner is not being charged.

Gonzalez was treated at a hospital and then taken into custody on suspicion of felony assault charges, including battery likely to cause great bodily injury, and felony vandalism. Police said they had not determined why Gonzalez was in the neighborhood or how long he had been asleep on the lawn.

ICE said the agent was off duty and alone at the time and referred questions to the Fresno Police Department.

The shooting drew a sharp local reaction. Fresno City Council member Mike Karbassi called for immigration enforcement operations in California's Central Valley to be suspended, saying the region had endured days of fear driven enforcement that had now tilted into outright violence.
