An Albuquerque mother is charged with murder after police say she sent her 10 year old son inside for her handgun and he shot a 16 year old girl dead
Albuquerque police charged Elaina Gomez-Villeda, 40, with an open count of murder on Sunday, a day after her 10 year old son shot and killed Keinerlein Rangel, 16, during a fight between neighbors over loud music. Police say Gomez-Villeda was fighting with the girl's mother, began hitting the girl when she tried to step in, and told her son to go inside and get her handgun. The boy came back out and fired one shot. Gomez-Villeda also faces charges of conspiracy to commit murder, child abuse, contributing to the delinquency of a minor and negligently making a firearm accessible to a minor. The charges are allegations and have not been proven in court.
The fight started over noise. According to Albuquerque police, Gomez-Villeda and her neighbor Susana Rangel got into a physical fight at their apartment complex on Saturday over loud music. Rangel told police her daughter Keinerlein tried to intervene, and Gomez-Villeda started hitting the 16 year old. Her own son, who is 10, also tried to step in. Police say that is when Gomez-Villeda told the boy to go inside the apartment and get her handgun. He came back outside with it and fired one shot, killing Keinerlein Rangel.
What followed was chaos at the doorway. Gomez-Villeda took her son inside and closed the door, and later told detectives she had texted her husband, “I'm probably going to jail right now.” She was the one who called 911. She told detectives the neighbors had attacked her after she complained about the music. While she was on the phone, the dead girl's father arrived, learned his daughter had been shot, and tried to pull her door open, breaking a window. Gomez-Villeda told detectives she grabbed a gun and shot at the man to make him leave. Officers arriving at that moment heard the shot and took cover. When she came out holding a handgun, one officer fired at her and hit a pillar. Nobody else was shot.
The boy has not been charged, and police are not naming him. Detectives are working with the District Attorney's Office and state officials on whether a 10 year old can face charges in the case. The additional charges against Gomez-Villeda include misdemeanor battery and receiving stolen property, a firearm. The Multi-Agency Task Force is investigating the shot the officer fired.
