Idaho prosecutors will seek the death penalty against a mother accused of suffocating her twin toddlers, deaths she blamed on vaccines

News story

An Idaho prosecutor has filed notice that the state will seek the death penalty against Andrea Shaw, 23, who is charged with first degree murder in the May 2025 deaths of her 18 month old twins. Shaw has pleaded not guilty and says the twins sickened and died after flu shots and routine childhood vaccinations. The county prosecutor wrote in court papers that an autopsy found signs consistent with smothering and that suffocation is the only conceivable explanation for the deaths, as of October 21.

The twins died on May 1, 2025, in Payette County, Idaho. They were 18 months old. Their mother, Andrea Shaw, told investigators the children became sick and died after receiving flu shots and routine childhood vaccinations a little more than a week earlier. A grand jury indicted her for first degree murder, and she was arrested on June 30, 2026. She has pleaded not guilty.

Prosecutors say the medical evidence points somewhere else. Payette County Prosecutor Mike Duke wrote in court documents that an autopsy revealed symptoms consistent with smothering, and that suffocation "is the only conceivable explanation" for the twins' deaths. The state alleges Shaw deliberately suffocated the children while they were sharing a bed.

Late last week, Deputy Prosecuting Attorney Ryon Sirucek filed the notice that raises the case to a capital one. The filing lists four aggravating circumstances the state says it will try to prove: that more than one murder was committed at the same time, that the killings were especially heinous, atrocious or cruel, that Shaw showed utter disregard for human life, and that she would pose a continuing threat to society. A jury would have to find at least one of those circumstances before Shaw could be sentenced to death, and only after a conviction. Under an Idaho law that took effect in July 2026, the firing squad is the state's primary method of execution.

Shaw's attorney, Joseph Filicetti, said in July that his client "denies anything and everything" and that the state "cannot prove" the charges. He did not respond to messages this week. Her trial is scheduled to begin on January 11, 2027. Shaw is presumed innocent unless a jury convicts her.
